    CPD COURSE WITHDRAWAL & REFUND POLICY

    This Withdrawal and Refund Policy explains the fees payable and any refunds due if you choose to cancel your enrolment on a CPD course.

    By submitting your enrolment, you indicate your acceptance of the terms set out in this Policy.


    1. Terms and Conditions of Withdrawal

    The Open College of Equine Studies (TOCES) operates on a pay-in-advance basis. The CPD course fee contributes towards the development and production of course content, online materials, and associated administrative costs. These costs are incurred before you begin your studies.
    By enrolling, you agree to be liable for the full course fee as detailed in this document.

    1.1 Right to Cancel

    Under the Consumer Contracts Regulations 2013, you have the right to cancel a service within 14 days of entering the contract.

    You enter a contract with TOCES on the date you pay your CPD course fee. This is your Enrolment Date.

    1.2 Digital Content

    • Viewing course content constitutes downloading digital content.

    • If you wish to access digital content within the 14-day cancellation period, you must agree to waive your cancellation rights.

    1.3 Refunds

    You will receive a full refund only if:

    • you notify us within 14 days of your Enrolment Date, and

    • you have not downloaded or viewed any digital course content.

    If you download or view digital content within the 14-day cancellation period, you are deemed to have accepted the terms of payment and have waived your right to cancel.

    LEARNER AGREEMENT

    These conditions form the basis of the agreement between The Open College of Equine Studies (the College) and the enrolled person (the Learner).


    2. Rights and Obligations of the Learner

    2.1 Payment of Fees

    2.1 The Service provided in return for the course fee includes:

    • Online e-learning course materials

    • Online assessments

    • A CPD course completion certificate (issued upon successful completion)

    2.2 The Learner is responsible for the full payment of fees, even if a third party has agreed to pay on their behalf.

    2.3 The full fee must be paid directly to TOCES before course access is provided.


    3. Refund of Fees

    3.1 College Closure

    3.1 If the College withdraws or closes a course for operational reasons, an alternative programme of a comparable size and level will be offered.

    3.2 Normally, at least 28 days’ notice will be given if a course is withdrawn.

    3.2 Voluntary Withdrawal

    3.3 If the Learner withdraws voluntarily, the conditions of the College’s Withdrawal Policy apply.


    4. Course Participation

    4.2 The Learner acknowledges that:

    4.2.1 TOCES is a distance learning college, and CPD programmes are delivered via self-directed online study.

    4.2.2 All course content — including text, graphics, images, video and audio — is provided for personal educational use only.

    4.2.3 All course materials are the intellectual property of TOCES.

    4.2.4 Course materials may not be reproduced, distributed, republished, sold, altered or reused in whole or in part, in any form or medium.

    4.2.5 Moodle login details are for the Learner only and must not be shared.

    4.2.6 If the College suspects a breach of this agreement, course access may be withdrawn and legal action may be taken.


    5. Course Completion and Extension

    5.1 The College’s completion and extension policy ensures Learners maintain satisfactory progress.

    5.2 The standard completion period is 104 days (90 days from 14 days after the Enrolment Date). Extensions may be granted in some circumstances.

    5.4 Extensions cost £30 per three-month period.


    Rights and Obligations of the College

    6. Services Provided

    6.1 The College will provide the necessary services and materials to support successful completion of the CPD course, including e-learning content, webinars, and tutorials.

    6.2 The College reserves the right to amend the number of learning hours or syllabus content.


    7. Liability

    7.1 The College excludes liability for any indirect or consequential loss suffered by the Learner arising from any breach of conditions or other act/omission by the College.

    7.2 If liability is established, the College’s liability is limited to the amount of fees paid, except in cases of death or personal injury caused by the College’s negligence.


    8. Circumstances Beyond the College’s Control

    8.1 The College may cancel or alter a programme without liability when required by circumstances beyond its control.

    8.2 The College may attempt to reschedule the programme but is not obligated to do so.

    10. Students with Disabilities

    10.1 TOCES is committed to fair and equal treatment for disabled students, including those with learning difficulties.  Where appropriate reasonable adjustments will be made to avoid substantial disadvantage.
